TERMS AND CONDITIONS FOR THE SALE, DELIVERY, AND USE OF LPG CYLINDERS

1. Introduction
These Terms and Conditions govern the sale, delivery, and use of LPG cylinders provided by
MamaGas. By purchasing from MamaGas, you agree to be bound by these terms and
conditions. These terms comply with the relevant laws and regulations governing the sale
and distribution of LPG in Kenya.

2. Definitions
• “MamaGas” refers to the company providing LPG cylinders for sale and distribution.
• “Customer” refers to any individual or entity purchasing LPG from MamaGas.
• “Cylinder” refers to the LPG container supplied by MamaGas.
• “Fault” refers to any manufacturing or safety defect that renders the cylinder unsafe
or unusable.

3. Orders and Delivery
• Orders can be placed through our website, mobile app, WhatsApp, or phone call.
• MamaGas will make every effort to ensure timely deliveries; however, delivery times
may vary based on location, weather conditions, and availability.
• Upon delivery, customers are responsible for inspecting the cylinder to ensure the
seal is intact and there are no visible defects.
• Once a cylinder is accepted upon delivery, the customer assumes responsibility for its
safe handling and use.

4. Product Use and Safety
• All cylinders supplied by MamaGas meet the required safety and regulatory
standards.
• Customers must use MamaGas cylinders only with approved regulators and hoses.
• Cylinders must be stored upright, in a well-ventilated area, away from direct heat and
flammable materials.
• Any misuse, tampering, or unauthorized refilling of the cylinder voids any warranties
or guarantees and may result in legal action.

5. Pricing and Payment
• Prices for LPG cylinders are subject to change based on market conditions, taxation,
and government levies.
• Payment must be made at the time of delivery unless a prior credit arrangement has
been approved in writing.
• Failure to make payment as agreed may result in legal action, penalties, or
suspension of service.

6. Return and Replacement Policy
• Cylinders with broken seals that are found to be in good working condition are non-
refundable.
• If a cylinder has a broken seal and is found to be leaking or defective, MamaGas will
replace it within two hours of notification.
• If a defect is discovered within three days of purchase, the customer must report it to
MamaGas for an investigation. After review, MamaGas will either issue a refund or
replace the cylinder at its discretion.
• Any reports of faults or leaks made beyond three days of purchase may be subject to
additional verification and may not be eligible for refunds or replacements.

7. Liability and Indemnity
• MamaGas is not liable for any damages, injuries, or losses arising from improper
handling, storage, or use of the LPG cylinder after delivery.
• The customer agrees to indemnify and hold MamaGas harmless from any claims,
damages, or legal actions resulting from unauthorized use or negligence.
• In case of an incident involving a MamaGas cylinder, the customer must report the
issue immediately to the relevant authorities and MamaGas.

8. Governing Law and Dispute Resolution
• These Terms and Conditions shall be governed by and interpreted in accordance with
the laws of Kenya.
• Any disputes arising from the sale, delivery, or use of MamaGas cylinders shall first
be addressed through mediation. If mediation fails, the dispute will be resolved
through arbitration as per the laws of Kenya.

9. Amendments and Updates
• MamaGas reserves the right to amend these Terms and Conditions at any time.
